1)This Service Agreement (“Agreement”) is entered into between High Mountain Camping AZ (hereinafter referred to as the “Provider”), located in Northern Arizona, and the undersigned customer (hereinafter referred to as the “Client”), on this___________ of year _____.
2. Client Responsibilities: The Client agrees to:
- Abide by all terms and conditions outlined in the rental agreement.
- Use the RVs solely for recreational purposes and in accordance with all applicable laws and regulations.
- Report any damage or mechanical issues to the Provider promptly.
- Indemnify and hold harmless the Provider from and against any claims, damages, losses, liabilities, and expenses arising out of or in connection with the Client’s use of the RVs.
3. Payment Terms:
The Client agrees to pay the Provider the agreed-upon rental fee for the use of the RVs. Payment shall be made in full prior to the commencement of the rental period. Any additional fees incurred during the rental period shall be paid by the Client upon return of the RVs.
4. Liability:
The Provider shall not be liable for any loss, damage, or injury arising out of or in connection with the Client’s use of the RVs, except to the extent caused by the gross negligence or willful misconduct of the Provider.
5. Governing Law:
This Agreement shall be governed by and construed in accordance with the laws of the State of Arizona(AZ), without regard to its conflict of law principles.
6. Termination:
Either party may terminate this Agreement upon written notice to the other party in the event of a material breach of any provision of this Agreement by the other party, provided that the breaching party fails to cure such breach within [number] days of receiving written notice thereof.
7. Entire Agreement:
This Agreement constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior and contemporaneous agreements and understandings, whether written or oral, relating to such subject matter.
